Leases

A lease is a contractual arrangement calling for the lessee (tenant) to pay the lessor (landlord) for use of an asset. A rental agreement involves an asset held in the possession by the lessee (tenant).

A lease involves many important clauses such as term, monthly payment, security deposit, and, on certain occasions, non-compete agreements. It is important to have a lease in place to make sure all parties concerns in writing, considered, and addressed by the other side. While not all concerns of both parties will be accepted in the final lease many can be and therefore should be drafted and reviewed by each party’s respective attorney. Also important to note, leases involves both real estate and personal property. Therefore, if you are considering leasing equipment and/or any other assets, a properly drafted lease agreement can protect your assets and you in the unfortunate circumstance of anything happening to your assets.
